After pressure from his family to take action against Theuns Du Toit, the Stellenbosch University student will now face criminal charges.
Initially on Tuesday, Babalo Ndwayana said he had chosen to forgive Du Toit for urinating on his belongings.
This happened on Sunday, 15 May inside Ndwayana’s res room, inside Huis Marais residence at the university.
However, Ndwayana’s family were not going to let the matter go and convinced their son to open a criminal case against Du Toit.
Babalo Ndwayana’s father, Mkuseli Kaduka said he was deeply upset that his communication to the university went unanswered.
Speaking to Algoa FM said neither Stellenbosch University, nor Du Toit’s parents reached out to his son or himself personally.
“I expected that the Institution would have reached out to me and that the family of the other boy would have reached out to me, then maybe we could have resolved this amicably,” he said.
He said because of their stance on the matter, he has urged his son to take the matter up within the ambit of the law and open a criminal case.
While the university has since suspended Theuns Du Toit, Ndwayana’s family say the disciplinary action is not enough.
The family have added their voice behind the student petition to have Du Toit expelled from the institution.
Kaduka has requested the university to hold urgent workshops with its students to highlight issues of inclusivity, racial discrimination and transformation.
In his letter to the university, he said “moving my son to a different room does not stop these issues from recurring.”
He said the university needs to find a permanent solution and set an example that such behaviour will not be tolerated.
Meanwhile, there has been another incident of racial discrimination at Stellenbosch University.
