The five men facing charges for the murders of Kiernan “AKA” Forbes and Tebello “Tibz” Motsoane will make another appearance at the Durban Magistrates Court on Tuesday, 19 March.
This after the murder suspects’ bail application was postponed on Monday owing to a dispute between the state and the defence.
The dispute pertained to accused No.4’s filing affidavit and the contents therein.
It was first argued by the State prosecutor that there was a problem as some of the defence council members had gained access to emails between himself and a separate defence lawyer in the matter.
Secondly, accused No.4’s affidavit contained the charge sheet of two of the other accused, currently in custody in eSwatini.
As reported by Kaya News, the court ruled that it will not view the charge sheets relating to the two suspects in eSwatini who are linked to the murders of the two high-profiled personalities.
Magistrate Vincent Hlatshwayo said the charge sheets of the two Durban-based men who were apprehended in eSwatini in February, are irrelevant to the information of the 5 accused currently before his court.
The 5 are facing 10 charges which include 2 counts of murder, 4 for attempted murder, 2 charges for the possession of firearms and ammunition, and 1 for conspiracy to commit murder. A further two charges of money laundering were added to the charges two weeks ago
They are:
- Lindokuhle Thabani Mkhwanazi
- Lindani Zenzele Ndimande
- Siyanda Eddie Myeza
- Mziwethemba Harvey Gwabeni
- Lindokuhle Lindo Ndimane
Meanwhile, accused No.2 – Lindani Ndimande, is requesting bail citing that he is the sole breadwinner at home and says his family will suffer without his financial contribution.

Due to forseeable circumstances that will mean the bail application will not be concluded during the 18 and 19 March appearances, the matter will then be postponed to 27 March.
The forseeable postponements are due to the availability of legal representatives.
