The South African Human Rights Commission (SAHRC) will institute Equality Court proceedings against Mr Nhlamulo “Nota” Baloyi for allegations of hate speech levelled against him.
This follows complaints about remarks Baloyi made on DJ Sbu’s Hustlers Corner podcast.
Baloyi, who recently saw rape charges against him being dropped, caused a stir on social media platform X when he said white peopel are inhuman.
He was heard saying: “They have Neanderthal blood in them.” “We are dealing with the weakest whites.” “White people are inferior species to us.” “White people are just below human being.”
On Monday, SAHRC gave an update in statement where they said they have found a prima facie case of hate speech against Baloyi.
“Following the publication of the podcast, the Commission opened its own-accord investigation and received complaints from across the country registered with the Gauteng Provincial Office. The SAHRC found a prima facie case of hate speech.
“In its assessment of the matter, the Commission considered the legal framework, which is primarily based on the Promotion of Equality and Prevention of Unfair Discrimination Act, 2000, and existing jurisprudence on hate speech.
“The Commission’s prayers will include a public apology, diversity and sensitivity training, community service, and a monetary fine, but they are not limited to these. Complainants who seek other remedies may open a crimen injuria case with the South African Police Service,” the SAHRC said in a statement.
