The Supreme Court of Appeal has dealt a significant blow to Dr. Nandipha Magudumana’s legal efforts, dismissing her application to have her arrest declared unlawful.
Justice Tati Makgoka delivered the judgment on Friday, ruling against Magudumana and ordering her to pay the legal costs associated with the appeal.
Magudumana had approached the Supreme Court of Appeal after the High Court previously rejected her bid. Her legal challenge stemmed from her apprehension in Tanzania in 2023.
She was arrested while on the run with her partner, convicted murderer Thabo Bester, who had infamously escaped from the Mangaung Correctional Centre where he was serving a life sentence.
Magudumana faces serious accusations of aiding and abetting Bester’s audacious prison break.
Today’s ruling by the Supreme Court of Appeal paves the way for the ongoing legal proceedings against her in connection with Bester’s escape.
