The DA has filed papers in the High Court challenging the recently signed Expropriation Act, claiming that it is unlawful on both substantive and procedural grounds.
According to reports, the DA’s documents were electronically submitted with the Western Cape High Court on Friday, 7 February 2025.
This comes after President Cyril Ramaphosa signed the Expropriation Bill into law in January. The Act repeals the pre-democratic Expropriation Act of 1975 and sets out how organs of state may expropriate land in the public interest for varied reasons.
In a statement released by the DA, they expressed how they reject the ANC’s attempt to smuggle powers to expropriate land without compensation.
“In the current Expropriation Act we reject the ANC trying to smuggle in further powers of expropriation without compensation in an Act that is meant to provide for expropriation in circumstances where the state needs to develop infrastructure such as roads, railways and dams.
Every country has legislation to ensure that the state can, with fair compensation, build public infrastructure, but this Act goes too far outside of these accepted international norms,” the DA said in a statement.
Democratic Alliance Federal Chair, Helen Zille says the party has serious reservations about various aspects of the act.
