On Tuesday, the court rendered a verdict of guilt on all four counts in a defamation case brought by Basetsana and Romeo Kumalo against Jackie Phamotse. The origin of this legal dispute traces back to a tweet posted by Jackie Phamotse in 2018.
Legal expert, Nthabiseng Dubzana from Dubazana Attorneys joined 959 Breakfast to provide a more comprehensive understanding of a case of this nature.
Dubzana defines Crimen injuria as “defamation of character within the realm of criminal law.”
“The complainant or the person who was defamed is not looking for any compensation or damages as a result of that, but they are looking for you to be criminally prosecuted and most likely to spend some time in custody should you be found guilty.”
Determining the duration of someone’s imprisonment is a complex process.”If it happens that you do have a previous conviction and you are still serving a suspended sentence on that previous conviction, it may lead to you being imprisoned for between three and five years, depending on how serious the defamation and your previous conviction are,” Dubazana explained.
Furthermore, she pointed out that, typically, the complainant doesn’t receive much except the satisfaction of “having their reputation restored.”
