The High Court in Pretoria has declared the Aarto Act and driver demerit system invalid and unconstitutional.
In 2020, the Organisation Undoing Tax Abuse (OUTA) launched an application to declare both the Aarto Act and the Amendment Act unconstitutional.
The driver demerit points system was proposed to be implemented from July 2022. Under the demerit system, drivers would be penalised for driving and traffic offences.
Should a driver accumulate a maximum of 15 points, their driver’s license would be suspended for up to 3 months.
Three suspensions would have been followed by the licence being cancelled. The driver would then need to retake their learner’s and driving tests from scratch.
While OUTA has welcomed Judge Annali Basson’s judgement, Transport Minister Fikile Mbalula is yet to decide whether to appeal the judgement or not.
OUTA CEO Wayne Duvenhage says the act was open to fraud and corruption and did nothing to ensure safety on the roads.
