Madlanga Commission to resume hearings as inquiry enters second phase

  • The Madlanga commission is pausing public hearings until November 9, 2026, due to media and livestreaming constraints surrounding the November 4 local government elections.
  • In camera sessions, a seminar, and final witness testimonies will occupy the upcoming schedule before the inquiry shifts focus to drafting its final report.
  • The final report is slated for submission to President Cyril Ramaphosa on January 25, 2027, with new public submissions now closed.

The Madlanga commission of inquiry into criminality and corruption within the criminal justice system has announced a temporary halt to its public hearings.

According to commission spokesperson Jeremy Michaels, public proceedings will resume on November 9, 2026.

The delay is primarily driven by practical hurdles regarding media coverage and livestreaming logistics during the lead-up to the November 4 local government elections.

Ahead of the public resumption, the inquiry will transition to in-camera hearings starting the week of October 5 to handle sensitive or confidential evidence tied to ongoing investigations.

The commission also plans to host a two-day seminar later in October to lay the groundwork for drafting its final report.

Looking toward the remainder of the year, the commission will finalise Phase 2 hearings featuring testimony from suspended police minister Senzo Mchunu before moving into Phase 3, which includes the return of KwaZulu-Natal police commissioner Lt-Gen Nhlanhla Mkhwanazi to the witness stand.

Throughout December 2026 and January 2027, the panel’s efforts will be dedicated entirely to compiling its final report for President Cyril Ramaphosa, which remains on track for delivery on January 25, 2027.

While general submissions via the hotline are now closed, the commission will still accept information relevant to matters already under active investigation by evidence leaders.

    • regulate, in harmony with international standards, the processing of personal information by public and private bodies in a manner that gives effect to the right to privacy subject to justifiable limitations that are aimed at protecting other rights and important interests,
    1. Definitions and Interpretation

    1.1.“Personal Information” means information relating to an identifiable, living, natural person and where it is applicable, identifiable, existing juristic person, including all information as defined in the Protection of Personal Information Act 4 of 2013. 

    1.2  Parliament assented to POPIA on 19 November 2013. The commencement date of section 1, Part A of Chapter 5, section 112 and section 113 was 11 April 2014. The commencement date of the other sections was 1 July 2020 (with the exception of section 110 and 114(4). The President of South Africa has proclaimed the POPI commencement date to be 1 July 2020.

     
    1.3. “Processing” means the creation, generation, communication, storage, destruction of personal information as more fully defined in the Protection of Personal Information Act 4 of 2013.  

    1.4. “You” or the “user” means any person who accesses and browses this website for any purpose.
