Former president Jacob Zuma has served the African National Congress (ANC) with a letter of demand in which he has given the party a deadline of 31 January to restore his membership or risk legal action.
In a letter addressed to ANC secretary general Fikile Mbalula on Wednesday, Zuma’s attorneys said that his dismissal as an ANC member was “illegal”.
After Zuma founded the MK party on 16 December 2023, the ANC’s national executive committee (NEC) charged him, however, the disciplinary procedure was postponed until after the elections on 29 May. He was eventually ousted by the ANC in July 2023.
In the letter to the party Zuma’s lawyer, Thabo Kwinana, raised both procedural and substantive issues with the ANC’s National Disciplinary Committee (NDC) and National Disciplinary Committee of Appeal (NDCA) procedures in the letter to the party.
“We are instructed to inform you that the aforesaid expulsion was illegal and/or in breach of both the ANC Constitution and/or the Constitution of the Republic of South Africa for various grounds,”
“We are therefore instructed to demand, as we hereby do, that the ANC must take all the necessary steps to ensure that such a reasoned ruling of the NDCA is furnished, without delay; our client is provided with all the full record of the NDC/NDCA proceedings including all outstanding documents and correspondence relevant thereto; and/or the expulsion ruling is immediately reversed with immediate effect pending proper compliance with the ANC Constitution and the Constitution of the Republic,” his lawyers KMNS Attorneys argued.
