Economic Freedom Fighters (EFF) leader Julius Malema and parliamentarian Mbuyiseni Ndlozi were found not guilty of common assault on Thursday by the Randburg Magistrates Court.
Even though Malema and Ndlozi’s actions appeared to be unconstitutional at first glance, the defence of justification was upheld, according to the Randburg Magistrates Court.
Judge Lieland Poonsamy made a favourable decision for them.
“The court finds that they the accused’s version is reasonably possibly true. Therefore, I accept that the defence of justification is to be upheld and that the accused had no intent to assault the complainant, based on the evidence.”
The attempt by Malema and Ndlozi to make peace with Venter outside of court as well as his rejection of the gesture, backed by AfriForum, was one of the concerns brought up by the magistrate on Thursday.

In June, the defence’s request to have the case deleted from the court register was denied.
Before Ndlozi and Malema were formally prosecuted, letters from AfriForum’s private prosecuting teams were sent to the National Prosecuting Authority.
