The Commission for Conciliation, Mediation, and Arbitration (CCMA) has ruled in favor of a Gauteng woman who was fired a year ago for refusing to receive the Covid-19 vaccination.
Kgomotso Tshatshu was fired in a way that was fundamentally unjust.
This was according to Commissioner Richard Byrne, who also mandated that Baroque Medical pay her a year’s worth of income of roughly R300k—by July 25.
Byrne found: “An employer has no right to formulate any Covid-19 vaccination mandate. It is the prerogative of government.
“Everyone, not just employees of a particular company, are equal before the law. The state has not unfairly discriminated against anyone in terms of vaccine policies. No legislation has been passed requiring all employees or citizens be vaccinated.”

The business that employed her provides hospitals with medical equipment.
Tshatshu, who was laid off a year ago, claimed she decided against getting the Covid-19 vaccine because she was afraid of it after having a bad reaction to the flu vaccine ten years prior.
