The Western Cape High Court has overturned Public Protector Busisiwe Mkhwebane’s suspension.
President Cyril Ramaphosa suspended Mkhwebane in June 2022.
Mkhwebane claimed on social media that Ramaphosa was after her because of her investigation into crimes like Glencore, the theft at his Phala Phala farm, and other scandals.
She has consistently insisted that her suspension was illegal and premature.

A parliamentary investigation regarding her eligibility for office is ongoing in the interim.
The court found that Mkhwebane’s decision may have been made in retaliation and was therefore unconstitutional because it was made hastily and sandwiched between the announcement of the investigation by Mkhwebane and the court’s judgment denying her request for an interdict.

The Presidency has released a statement saying they have noted the court’s judgement.
“The Presidency has noted the ruling handed down by the Western Cape High Court this afternoon, 09 September 2022, stating that President @CyrilRamaphosa ’s decision to suspend Adv. Busisiwe Mkhwebane is invalid.
The Presidency will seek guidance from the Constitution on the next steps.” read the statement.
