It’s D-Day for Nosiviwe Mapisa-Nqakula who is expected to hand herself over to police after failing in her bid to interdict her arrest over corruption and money laundering charges.
This after the Pretoria High Court dismissed her application on Tuesday, 02 April to stop her arrest by the National Prosecuting Authority’s (NPA) Investigating Directorate (ID) from arresting her.
On Tuesday, 19 March the ID conducted a search and seizure operation at the Speaker’s Bruma home.
The walls around the disgraced Speaker of Parliament are crumbling after an investigation brought to light that she allegedly accepted over R4 million in bribes.
These alleged transgressions reportedly took place while Mapisa-Nqakula was moonlighting as Defence Minister, between November 2016 and July 2019.
Amongst the allegations Mapisa-Nqakula faces, is the 70% salary increase that she now needs to explain authorizing for Parliament’s Secretary, Xolile George.
George’s annual salary increased from R2.6 million to R4.4 million in less than a year, which meant he earned more than President Cyril Ramaphosa following his appointment in June 2022.
Judge Sulet Potterill dismissed Mapisa-Nqakula’s application saying the court cannot interdict to prevent authorities from carrying out their statutory duties.
“The court cannot interdict to prevent authorities from complying with their statutory duties. It is not as if the State representatives have not been lenient in letting 2-weeks go by.
With regards to the court determining if arrest will be unlawful, in reply on behalf of the applicant it was submitted that I only need to take a peek into the docket if I’m uncertain.
I’m not uncertain, and I exercise my discretion not to take a judicial peek.
This court is not a means to declare an arrest which has not taken place, unlawful or that it would be unlawful or express a view thereon.
I am therefore also not granting this order.”
Nosiviwe Mapisa-Nqakula is expected to hand herself over to the Lyttleton police station in Centurion.
The beleaguered Speaker of Parliament faces 12 corruption charges and one charge for money laundering.
