Cachalia was appointed earlier this month by President Cyril Ramaphosa, following Police Minister Senzo Mchunu’s leave of absence.
Mchunu was placed on leave after being implicated in serious corruption allegations by KwaZulu-Natal Police Commissioner Nhlanhla Mkhwanazi.
The commissioner accused Mchunu of interfering in sensitive investigations and colluding with a murder-accused businessman to disband a task team probing political killings.
On Thursday, 31 July, the uMkhonto weSizwe (MK) party approached the Constitutional Court to block Cachalia’s appointment, arguing that he is not a Member of Parliament.
However, the apex court dismissed the case, ruling that it lacked jurisdiction to hear the challenge.
Cachalia, who resigned from his position as a professor of law at Wits University, will now officially assume his new role in the police ministry.
