Thabo Bester and Dr Nandipha Magudumana’s application to stop the Showmax documentary, Tracking Thabo Bester will be heard by the High court in Johannesburg.
The day the documentary was set to air, (Friday, 15 March) the “Bonnie and Clyde” couple’s last-minute applications to stop the documentary because it threatens their rights will be heard in court.
MultiChoice confirmed on Thursday, 14 March that the matter will be taken to the High Court, and says Showmax has briefed legal counsel to vigorously oppose the applications.
Multichoice has responded to the letters of demand from Dr Nandipha Magudumana and Thabo Bester to stop the airing of Tracking Thabo Bester, a documentary that is set to air on Showmax.
Last week, Magudumana and Bester through their legal team have claimed that no in-person interviews were conducted, and citing that streaming the series could result in irreparable harm.
Apart from threatening further lawsuits for damages, Magudumana asserts that she did not grant any party the right, permission or authority to film the documentary.
Meanwhile, her lover, convicted rapist and murderer Thabo Bester, says he has not granted Showmax or any person the rights or authority to produce, distribute or commercially explot a documentary of film based on or taken from his life.
In response Multichoice said it will proceed and air Tracking Thabo Bester on 15 March, despite the letters of demand.
However, due to the urgent application put forward, whether the channel will be allowed to air the series will be determined by the court.
MultiChoice maintains that the public has every right to view the documentary and form their own opinions after watching how the infamous couple allegedly planned and executed Bester’s brazen escape from the Mangaung Correctional Center in May 2022.
“The allegations against Mr Bester and Dr Magudumana are incredibly serious and Showmax strongly believes that it is essential for viewers to have the opportunity to watch the documentary and form their own informed opinions.
Showmax is of the view that the attempt to stop Showmax from doing so is without any legal merit and breaches the constitutional rights of the public.”
