The African National Congress (ANC) is intent on appealing the Durban High Court ruling on the uMkhonto weSizwe (MK) Party logo and name.
Point of View with Phemelo Motene spoke to legal expert Mpumelolo Zikalala about the case.
This after the court dismissed the ANC’s bid to block the MK Party which is spearheaded by former President Jacob Zuma, from using the name and logo that is a trademark of the ruling party’s military wing.
The ANC disputed that the name of the MK Party and use of the Mkhonto We Sizwe logo, was misleading and cautioned people against associating the MK Party with the ANC.
In response, the MK Party argued that the ANC does not own the rights to the uMkhonto weSizwe name and logo.
On Monday, 22 April shortly after the court’s decision, ANC Secretary-General Fikile Mbalula said while the ANC is committed to respecting the rules of the country for a free and fair election, they would be appealing the decision on the MK Party’s logo and name.
Mbalula says Zuma was aware of the impact of his actions the moment he announced that he would be campaigning for the MK party in attempts to save the ANC.
Mbalula says Zuma’s actions continually prove that he is against the governing party.
In January, Zuma was suspended from the ANC for endorsing the MK Party, in a move that Mbalula called counter-revolutionary.
“The ANC has not called a special meeting of the National Executive Committee (NEC) to reconsider its own decision because Zuma now has registered the party.
He’s moved many steps since the time we suspended him. He has formed a party, he’s now a leader.
When we suspended him, he was just a supporter, not even a leader. The leader was Khumalo.
So, he has stood, and now he’s on the ballot going up against the ANC.
He is campaigning effectively against the ANC. So, when the ANC when it convenes an urgent meeting and decides to expel Zuma you are going to say we are promoting him.
How do you promote something that lives out there? It exists on distortion to an extent that those distortions become a fact to the people and we need to correct them.”
