The 12-year-old boy accused of causing a fatal car accident in Brakpan on Saturday has been released into the custody of his parents following his court appearance on Monday.
The minor, who cannot be named due to legal restrictions, appeared before the Brakpan Magistrates Court where he faced charges of culpable homicide and driving a motor vehicle without a licence.
It is alleged that the child was driving his parents’ vehicle on Saturday, 7 June 2025, when he hit 14-year-old Malcom Booysen. Booysen succumbed to his injuries and was declared dead on the scene by paramedics.
When Kaya News visited the site of the incident, a memorial cross had been placed on a nearby tree in remembrance of the teenager.

According to National Prosecuting Authority (NPA) spokesperson Lumka Mahanjana, the case has been postponed to 28 August 2025 to assess the boy’s criminal capacity.
