David Mabuza’s daughter challenges wife’s claim to R44m pension fund

It has been reported that one of the late Deputy President David Mabuza’s children has approached the court on an urgent basis to halt the distribution of his R44 million pension until she has enforced her rights as a beneficiary.
She is also challenging the legality of the marriage certificate produced by Mabuza’s wife.
On Thursday morning, Managing Director at Mashitisho Attorneys, Kholofelo Mashitisho, spoke to Sizwe Dhlomo about the unfolding legal battle.
Mashitisho explained that the daughter qualifies as what is legally defined as a dependent.
“Section 37C of the Pension Funds Act says that the trustees of a fund, in this case Alexander Forbes, have the discretion to decide how the benefit is allocated,” she said.
She further explained that Alexander Forbes cannot make the entire payout to the wife until it is established whether or not there are other dependents.
