Mother sentenced to 12 months in prison for denying father access to child.
A ruling has been made that a mother who disregarded two court orders giving her ex-husband access to their child now faces a 12-month prison sentence for contempt of court.
In this week’s legal matters Nthabiseng Dubazana on Point of View with Phemelo Motene, there was a discussion on the recent case and Dubazana took some time to tackle other legal questions from Kaya 959 listeners.

Dubazana unpacked the case and said, “From what I could see the address of the mom was in Limpopo and Dad was based here in Gauteng, it is going to be a huge change for the child.”
According to the judgment, the mother who disobeyed court orders and prevented her father from seeing their child for the previous three years was given a 12-month jail sentence.

In August 2021, a judge made an order in favor of the father, which the mother disregarded. This is despite the father’s diligent monthly maintenance payments of R15,000 for the child’s upkeep.
In June 2022, he went to court once more to try and get custody of his child. This time, the judge ruled in his favor, but the mother disregarded the ruling.
The mother was also found to be in contempt of court during the latter order.
