Mohale Motaung is going to have to prove he was married to Somizi Mhlongo in order to secure 50% in their divorce.
This after reports suggest the couple were not legally married, having failed to have their union registered at Home Affairs.
In his reality show, Living The Dream with Somizi, the media personality revealed that there were so many reasons why their marriage was not made legally official.
Firstly, on the day of their wedding, the pastor had forgotten to bring the marriage certificate. The two never went to have their marriage registered after their wedding either.
According to the City Press, the two were not legally married and the non-existent marriage certificate has brought their divorce proceedings to a grinding halt.
Mohale will now have to provide proof that lobola was paid so that the divorce can be handled from a customary law standpoint.
Unfortunately, Mohale doesn’t have any proof in the form of documents or a receipt that lobola was paid. He will have to call on witnesses to prove they were married under customary law or obtain a high court application to recognise their marriage.
On his show, Somizi met with Hopewell Sathekge, a legal advisor whom he sought advice on his divorce from.
Somizi was told that there were a number of ways to prove the validity of the marriage.
“It can be proved by pictures, affidavits, a lobola letter, receipt of payment. If the payment was made in cash, an affidavit could suffice.”
On Sunday, Mohale responded to tweets asking how he could have “fumbled the bag” by not signing a marriage certificate, as he now stands to lose everything in the divorce.
His response, “The day I bump into Angie Motshekga,” interpreted to mean that he wasn’t thinking clearly and was clearly blinded by love.
