Dr Nandipha Magudumana bail application denied, state believes she will evade justice if she’s released.
On Tuesday, Magudumana appeared in court in Bloemfontein for the first day of her two-day bail application.
The state was against bail. Magudumana had “substantial incentive to evade trial,” according to an investigating officer.
Point of View with Phemelo Motene spoke to Legal Expert Mpumelelo Zikalala, who unpacks the Concourt independent candidates legal challenge as well as new information that has emerged during Dr Nandipha Magudumana bail application.

On Tuesday Magudumana argued before the judge that she ought to be given bail.

She declared that she will enter a not guilty plea to the accusations leveled against her, which include fraud, aiding an escape from detention, and violating bodily integrity. She also said that she had no desire to leave the South Africa and that her passport, which was still in the custody of the police, served as her only means of travel.
She stated that if granted bail, she would reside in Sandton with a friend.
Legal Expert Mpumelelo Zikalala spoke about some of the legal issues the court was specifically looking at during the bail hearing that led to her being denied bail.
“There are only four principles the court looked at. Are you a danger to the public, that’s the first one, are you going to evade trial, are you going to temper with witnesses, and is the granting of the bail going to undermine the principles of justice?
If all those factors in have a no answer, then you can be granted bail.” said Zikalala
