The Special Tribunal has mandated that Buthelezi EMS and its affiliated entities return undue benefits derived from approximately half a billion Rand in illegal tenders issued by the Free State Health Department.
The tribunal’s ruling declared the contracts, awarded for inter-facility emergency medical services, to be unlawful, unprocedural, and in violation of the Constitution.
The Special Investigating Unit (SIU) brought the civil case before the tribunal, challenging tenders valued at roughly R532.8 million awarded to Buthelezi EMS and its associated companies.
The SIU’s investigation, initiated through a 2019 proclamation, aimed to address alleged irregularities in the awarding of these substantial contracts.
The Special Tribunal has ruled against Buthelezi EMS and its affiliated companies, declaring the Free State Department of Health’s award of multi-million-rand tenders for inter-facility emergency medical services unlawful, unprocedural and unconstitutional.

According to the SIU, civil proceedings were instituted to review and set aside the irregular tenders awarded to Buthelezi EMS, as well as the subsequent contract.
The Department paid a staggering R532,789,770.12 to four companies linked to Mr. Buthelezi, despite having no valid contracts in place.
The payments were made as follows:
- •Buthelezi One Stop Emergency Med: R40,619,506.40
- •Buthelezi One Stop EMS: R4,739,819.04
- •Buthelezi EMS: R305,196,897.00
- •B EMS: R182,233,548.12
The tribunal’s order requires Buthelezi EMS to provide comprehensive audited financial statements detailing all income, expenses, and profits accrued under the disputed contracts. Furthermore, the company has been instructed to cover the legal expenses incurred by both their own application and the SIU’s legal representatives.
The SIU emphasized that this action is part of a broader strategy to implement the outcomes of their investigations and ensure accountability for financial losses suffered by state institutions due to corrupt or negligent practices.
