Ousted uMkhonto weSizwe (MK) Party member, Jabulani Khumalo has filed an urgent application with the Western Cape High Court to have him reinstated as a Member of Parliament.
This after the Electoral Court dismissed Khumalo’s last-minute motion to deem Jacob Zuma’s elevation to leader of the MK Party unconstitutional and illegal.
On Wednesday, 12 June the court found that Khumalo has no grounds to claim that he is the leader of the MK Party.
Khumalo claimed that a member of the newly formed party, which won the majority of the vote in KwaZulu-Natal, forged his signature on a party form which indicated Khumalo would be relinquishing his role as leader of the party to Zuma.
However, the court found Khumalo had wasted its time and placed the opposing respondent in an unfair position to incur legal costs.
The court ruled Khumalo would be liable to pocket the costs in order to send a message to the public that making false statements under oath and abuse of the court’s process will not be tolerated.
Khumalo was ordered to pay the third and fourth applicant’s legal costs, after finding the respondent’s version well-substantiated and not far-fetched.
On Thursday, 13 June Khumalo is demanding that he be reinstated to MK Party’s parliamentary list, a day before the first sitting of the National Assembly which is set to take place on Friday, 14 June.
