On Monday, 22 April the Durban High Court ruled in favour of the MK Party, dismissing the ANC’s bid to block the party that’s spearheaded by former President Jacob Zuma from using the name and logo.
While the ANC said it will not back down in it’s fight against the MK Party, the court dismissed the bid by the ANC in a matter of minutes.
In March the ANC lost its bid to deregister the MK Party from the 2024 elections.
The ANC disputed that the name of the MK Party and use of the Mkhonto We Sizwe (military wing of the ANC) trademark logo, was misleading and cautioned people against associating the MK Party with the ANC.
In response, the MK Party argued that the ANC does not own the rights to the uMkhonto weSizwe name and logo.
Speaking outside the Durban High Court after the court ruling, MK Party Founder Jabulani Khumalo said the ANC has been trying to stop the formation of their party because they are scared of losing the elections.
“For us, this win shows the whole world that the ANC has been trying, without facts to stop us because they knew that we are going to win the elections.
So, they’re doing this in order to stop us but they can’t stop us.”
Khumalo says now that this matter is put to rest the party can focus on campaigning to ensure a two third majority victory in the upcoming elections.
Earlier this month the MK Party and Zuma won their case against the IEC disqualifying the former President from running in the elections.
This after the IEC ruled that Zuma would not be on the ballots this year following his 2021 conviction for contempt of court.
Zuma was sentenced to 15-months in prison by the Constitutional Courtm and according to Section 47 of the Constitution, any person who has served more than a year in prison is unable to serve as a member of Parliament.
