The MK party and Zuma win their case against IEC disqualification at the Electoral Court.
uMkhonto Wesizwe (MK) has maintained its winning run in the legal system and is determined to keep former president Jacob Zuma on its parliamentary lists.
Zuma’s inclusion on the party’s candidate list sparked concerns since it seemed that he violated the clause in the Constitution that prohibits candidates from running if they have been convicted of a felony for twelve months or longer, without the option of paying a fine, during the previous five years.
The MK party filed an appeal when a member of the public protested Zuma’s nomination and the IEC upheld the complaint.
On Tuesday afternoon, the Electoral Court declared that the complaint to Zuma’s candidacy as a member of Parliament had been overturned and that it was giving the MK party permission to appeal.
An order was granted allowing Zuma to be on the ballot box on the 29th of May.
“The application for leave to appeal is granted. The appeal succeeds. The decision of the Electoral Commission of 28 March 2024 in terms of which the Electoral Commission upheld Dr [Maroba] Matsapola’s objection to the second applicant’s candidacy (Mr Zuma) is set aside and substituted with the following: ‘The objection is hereby dismissed’,” the order reads.
