Chief Justice Raymond Zondo joined President Cyril Ramaphosa at the national anti-corruption dialogue in Boksburg earlier in the week. During his speech, he shared his comments on many political issues, including the Zuma-Gupta relationship, the disbanding of Scorpions, etc. 959 Breakfast invited Legal Analyst Mpumelelo Zikalala to share his insights on Zondo’s utterances and opine on whether he should share these remarks publicly.
Zikalala points out that the Judicial Services Commission has issued a code of conduct that outlines the expected behaviour of judges.
“If you look at article number two, it says that the code of conduct applies to all judges, and most importantly, article number 11 talks about restraint.
“If there is a matter pending in another court, you are not allowed to comment on that particular matter. You must leave the legal commentary to us legal analysts. This restriction also applies to ongoing cases, such as the state capture commission and any other matters discussed in court.
However, Zikalala suggests that it is acceptable to mention these issues without naming the individuals involved. It is better to speak about corruption in a general sense.
