Judge Tshifhiwa Maumela has dismissed Zandie Khumalo’s application for her testimony to not be broadcast live in the Senzo Meyiwa murder trial.
Proceedings in the trial were postponed on Monday, after the next State witness, Zandie Khumalo, requested for her testimony to not be broadcast via audio or visuals.
The younger sister of singer Kelly Khumalo said she feared her testimony being broadcast by media would endanger her life and subject her to further public scrutiny.
Judge Maumela deliberated on Zandie’s application and on Thursday, 18 May dismissed her application for her testimony to be broadcast.
While Zandie may not be filmed, and no pictures of her may be taken during court proceedings, her audio testimony will be made available to the public.
Judge Maumela said this was due to the massive public interest in the case, which needed to be taken into consideration.
“Live broadcast of the image of the witness will not be permitted, members of the media are permitted to live broadcast the testimony of the witness by means of audio.
The prohibition of images of the witness while she testifies shall remain in place until the finalisation of this case.
While the court understands that beaming her face may bring unintended adverse consequences to bear against her, there is no evidence showing that the public broadcast of her voice will disadvantage her.”
Zandie, was one of the occupants inside he family’s Vosloorus home on the night Senzo Meyiwa was murdered.
Taking to the witness stand Zandie shared her version of events with the court, saying her family were joking and laughing when two men entered their home, demanding cellphones and money.
“I heard a click of a firearm and, my partner at the time, Longwe Twala stood up and pushed the one with the dreadlocks, who had the firearm and pushed him backwards.
Longwe managed to go out of the kitchen door. Kelly ran to the bedroom which is mine. Kelly was followed by one of the accused, who tried to push the door.
Then we all got up and pushed both of them towards the kitchen. We were fighting them towards the kitchen. Our door to the kitchen opens to the inside.”
Zandie said a scuffle between Senzo and the armed intruder ensued, and a short while after a gunshot went off, the spark from the firearm hit her leg.
Court has been adjourned for the day and Zandie Khumalo will be back in court on Friday, 19 May.
