As the first eyewitness took to the stands in the Senzo Meyiwa murder trial, Kelly Khumalo’s lawyer was instructed to vacate the court.
This due to the defence raising objection to the presence of Kelly Khumalo’s lawyer, Magdalene Moonsamy who was present in court since the trial began.
Moonsamy has been conducting a watching brief for her client who was a victim of the botched robbery in which her footballer boyfriend Meyiwa was gunned down.
According to Moonsamy, there is a need for her to be present at the trial because one of the assessment being withdrawn, the medical conditions and harassment.
However, Malesela Teffo, advocate for the defence said Moonsamy’s presence made his clients uncomfortable.
Teffo is representing four of the five men accused for the the murder of Senzo Meyiwa.
Meyiwa’s murder trial resumed on Friday, 22 April after much delay since the trial resumed earlier in the month.
The 5 men accused of Meyiwa’s murder are Mthobisi Prince, Bongani Sandiso Ntazni, Muzikawukhulelwa Sibiya, Sifisokuhle Nkani Ntuli and Mthokoziseni Maphisa.
Senzo Meyiwa, the former Orlando Pirates and Bafana Bafana goalkeeper was shot and killed at an attempted robbery at Kelly Khumalo’s Vosloorus home in October 2014.
A police officer who photographed the crime scene was the first eyewitness on Monday, 25 April.
Sergeant Thabo Mosia, a forensic fieldworker took several photographs of the crime scene, detailing that the kitchen door which had a bullet hole was the point of entry.
The five accused are pleading not guilty to all charges including murder, attempted murder, robbery with aggravating circumstances and illegal possession of a firearm and ammunition
