Phoenix community is calling for the release of those allegedly accused of murder

Families of suspects currently in jail for various crimes allegedly committed during the unrest that swept Durban in July have finally broken their silence as their loved ones continue to remain behind bars.

Visvin Reddy, the leader of African Democratic Change (ADeC) led a motorcade from Gandhi-Luthuli Peace Park to the Phoenix Police Station, on Saturday, 25th of September, to hand over a Memorandum of Demands.

Reddy said that those who have created the serious crime are walking free as they continue to instigate treason against the state.

“The court is one-sided and seems to favour the stance that the upsurge of communities to protect themselves were racially motivated rather than to look at the serious crime that occurred prior to the incidents. The cases have been prejudged in line with a certain political agenda,”

Speaking to the Phoenix Tabloid Christina Naidoo, (not real name), alleged that her two uncles, Nizam Mohamed, 50 and Firoz Mohamed Fakeer, 49, have been unfairly arrested. He spoke about how unfair the legal process has been towards his family members.

“The court has been captured. The bail application process is like a trial. How is it that the instigators of the unrest got bail but not the Phoenix accused? There were drive-by shootings, and the community received death threats. If the looting did not take place, then our people would not have had to protect the community. The accused should be pardoned because of the circumstances.” said Naidoo.

Naidoo spoke about the false narrative that’s been perpetuated in mainstream media:

“They have appeared five times in the Verulam Magistrate’s Court. Four times they were told that there were no transcripts and the systems were down which caused delays. On the fifth appearance, bail was denied. Family who attended court said that the reason for denying bail was that the communities have claimed that since the two accused are in jail there has been peace and calm. This is false rumours and a narrative used to keep them behind bars.”

    • regulate, in harmony with international standards, the processing of personal information by public and private bodies in a manner that gives effect to the right to privacy subject to justifiable limitations that are aimed at protecting other rights and important interests,
    1. Definitions and Interpretation

    1.1.“Personal Information” means information relating to an identifiable, living, natural person and where it is applicable, identifiable, existing juristic person, including all information as defined in the Protection of Personal Information Act 4 of 2013. 

    1.2  Parliament assented to POPIA on 19 November 2013. The commencement date of section 1, Part A of Chapter 5, section 112 and section 113 was 11 April 2014. The commencement date of the other sections was 1 July 2020 (with the exception of section 110 and 114(4). The President of South Africa has proclaimed the POPI commencement date to be 1 July 2020.

     
    1.3. “Processing” means the creation, generation, communication, storage, destruction of personal information as more fully defined in the Protection of Personal Information Act 4 of 2013.
