Self-proclaimed Prophet, Shepherd Bushiri, and his wife, Mary, have been dealt another legal setback in Malawi.
The court has now ruled that their extradition case will continue being heard as a criminal case.
Their legal team had requested that the matter be heard as a civil matter.
The couple fled South Africa while on bail in November last year.
They were facing multiple charges, including fraud and money laundering.
Another application rejected
The setback is another blow for the couple’s case. Bushiri’s legal team had earlier attempted to have Magistrate Patrick Chirwa removed.
His lawyers argued that the extradition hearing was moved from Magistrate Viva Nyimba to Chirwa without the team being notified.
They also objected to Chirwa’s handling of the case.
The application was denied.
Bushiri’s lawyers also requested that South African witnesses whose statements appear in the extradition documents should be summoned to Malawi.
Malawian prosecutors argued that the hearing was not a trial but a preliminary inquiry and therefore no summons was necessary.
