ActionSA’s Ekurhuleni mayoral candidate, Xolani Khumalo, has been acquitted of assault with intent to cause grievous bodily harm (GBH) and pointing a firearm.
The high-profile case concluded on Thursday at the Palm Ridge Magistrate’s Court, clearing Khumalo of all legal jeopardy.
Khumalo stood trial alongside Duma Radebe, the chairperson of the Gauteng Anti-Crime Units.
The magistrate granted both men a discharge under Section 174 of the Criminal Procedure Act, formally ruling that they were not guilty after the state failed to present a sufficient case.
The legal battle originated from a televised anti-drug raid conducted on 19 December 2025 in Katlehong, Ekurhuleni.
A suspected drug dealer, Bongani Radebe, alleged that Khumalo and his team assaulted him and threatened him with a firearm inside his property.
Following their arrests in January 2026, the accused were released on bail R500 for Radebe and R2,000 for Khumalo.
Throughout the trial, prosecutors argued that Bongani Radebe was beaten with a weapon and threatened in breach of the Firearms Control Act.
However, both defendants maintained their innocence and entered not-guilty pleas, ultimately securing total vindication in court.
