Convicted serial rapist and murderer Thabo Bester has escalated his legal battle regarding his prison conditions, seeking intervention from the Constitutional Court.
This move comes after the Free State High Court in Bloemfontein dismissed his attempt to challenge his incarceration conditions and his request to have laptop access.
In a February 2025 ruling, the High Court determined that his objection to the civil court’s jurisdiction lacked merit, effectively halting his challenge.
According to SABC News Bester, through his legal representation, filed papers with the Constitutional Court on Monday, seeking leave to appeal the High Court’s decision. His attorney’s founding affidavit argues that the lower court’s judgment represents a “travesty of justice” and deviates from the core issues at hand.
This Constitutional Court appeal arrives amidst a simultaneous, conditional application for leave to appeal before the Free State High Court.
Bester, along with his co-accused, faces a slew of charges stemming from his elaborate escape from prison, a case that has captured national attention.
The current legal maneuver regarding his prison conditions adds another layer of complexity to the ongoing proceedings.
The Constitutional Court will now decide whether to hear Bester’s appeal, potentially setting a precedent for prisoner rights and jurisdictional disputes within the South African legal system.
