In a ruling that exposes police negligence and a shocking miscarriage of justice, Mr. Xulu has been awarded R 2.5 million in damages for his wrongful detention. This harrowing case highlights the dire consequences when law enforcement fails to uphold their duty to investigate claims of innocence.
Mr. Xulu’s ordeal began when he was arrested on his way to the police station to report an attempted robbery in which he had acted in self-defense by shooting one of the assailants. Despite his attempts to explain the situation to the police, he was arrested and detained for an extended period without proper investigation.
The court found that the police failed to comply with their duties, as they did not take reasonable steps to investigate Mr. Xulu’s claim. He presented no flight risk and cooperated with law enforcement. Crucially, it would have taken minimal effort to determine that the crime scene was just outside Mr. Xulu’s home.
The police’s astounding position during the trial was that it was not their responsibility to inform the prosecution of Mr. Xulu’s defense. However, the court highlighted that it is a clear and well-established public duty for law enforcement to disclose all relevant facts to the prosecution. This omission, coupled with a shoddy investigation and inexplicable delays, compounded the injustice Mr. Xulu endured.
During his wrongful detention, Mr. Xulu faced appalling conditions and physical assaults from other inmates. He was separated from his family for over two years, including his youngest daughter, who relied on him for medical attention. Mr. Xulu’s shocking experience led to a mental breakdown, hospitalization, and a profound loss of over two years of his life.
The court, considering these factors and the unique circumstances of Mr. Xulu’s case, awarded him R 2.5 million for the period of his subsequent detention. Additionally, he was granted R 100,000 for his unlawful arrest and initial detention.
