With fresh allegations coming to light, advocacy groups, The Muslim Lawyer Association and the South Africa Kashmiri Action Group are calling for Indian Prime Minister (PM), Narendra Modi to be arrested in South Africa when he attends the BRICS Summit.
The two groups lodged a joint complaint with the National Prosecuting Authority (NPA) and SAPS to arrest, investigate and possibly prosecute Modi when he arrives in the country in August.
This despite the South African government granting all BRICS delegates immunity for the duration of the summit.
Modi has been accused of several crimes in Indian-occupied Kashmir including evidence of abduction, tortures, rapes, extra-judicial killing, arson attacks and illegal arrest of political leaders and innocent civilians.
In a statement, both groups detailed the human right violations levelled against Narendra Modi, his government and the Indian Army.
“The defining feature of human rights violations in the last 220years in Jammu and Kashmir has been that the Indian armed forces have leveraged counter terrorism to possible war crimes with impunity.
When survivors approached authorities to investigate they have used counter terrorism to ineffectively address possible war crimes, and disregard the people of Jammu and Kashmir.”
According to Advocate Yousha Tayob, and Chairperson of the South Africa Kashmiri Action Group, Salman Khan, there is fear over the disappearance of almost 8 000 people, over 70 000 deaths and more than 6 000 unmarked mass graves which they want the Indian PM to be held accountable for.
“Prime Minister Modi has command responsibility and superior responsibility.
Superior responsibility is a form of omission liability, a superior authority is responsible for failing to prevent or punish crimes committed.
The dossier contains clear prima facie evidence to justify arresting Mr Modi when he attends the BRICS summit in South Africa on 22-24 August 2023.”
