EFF leader Julius Malema and his bodyguard Adriaan Snyman want the magistrate in their firearms case to recuse herself.
Magistrate Twanet Olivier shared that the court ruled in favour of the state-submitted evidence of Malema discharging a firearm at the Sisa Dukashe Stadium in 2018.
The authenticity of the video footage was initially brought into question by the defense.
However, Magistrate Olivier ruled that the footage is good enough to be used by the state as evidence.
The defense argues that the magistrate has made an error in allowing the footage to be used because it does not give a clear depiction of the events that happened at Sisa Dukashe Stadium in 2018.
Malema and Snyman are set to make an application to remove Magistrate Twanet Olivier as the presiding judge.
This was revealed in the East London Magistrate’s Court today where the trial against the two continues.
