The motion of no confidence used to remove former Joburg mayor Mpho Phalatse from office on September 29 has been pronounced unlawful and invalid by the Gauteng High Court, siding with Phalatse.
According to the DA’s reading of the ruling, Phalatse was restored on Tuesday, October 25, when Judge Raylene Keightley agreed with her that the issue needed to be resolved quickly.
The council’s selection of Dada Morero as mayor of Johannesburg has been ruled illegal, unconstitutional, and illegitimate. As a result, Judge Keightley ruled that all of the ANC’s Morero’s rulings were illegal, unconstitutional, and invalid and should be reviewed and overturned.

Last week, the Democratic Alliance (DA) claimed that Johannesburg Council Speaker Colleen Makhubele’s decision to convene an extra council meeting two days following her election last month was illegal.
Phalatse has praised the court decision on Tuesday, calling it a triumph for democracy.

Dada Morero has also released a statement saying he would set aside as Mayor of Johannesburg. He later, deleted and retracted the statement and said the lawyers were studying the judgement.
